OFFICIAL RULES:
These are the official rules (“Rules”) for the Grateful Week Giveaway (“Promotion”). The Promotion is sponsored by Red Clay Strays, LLC (“Sponsor”). By entering or otherwise participating in this Promotion, you agree to be bound fully and unconditionally by these Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Promotion, and to comply with all applicable rules and regulations. Sponsor has the right to reject and disqualify you for any reason, in its sole and absolute discretion. Winning prizes is contingent upon fulfilling all requirements set forth herein.
This Promotion is only open to any person who has reached the age of majority or older at the time of any entry; and is a legal resident of the 50 United States and District of Columbia, excluding Rhode Island, Guam, Puerto Rico, U.S. Virgin Islands. Current or former, officers, and directors of Sponsor or other affiliated entities as well as their immediate families are not eligible to participate in the Promotion. Void in any state where prohibited by law. All federal, state and local laws and regulations apply. Any person that submits to participate in this Promotion (“Entry”) will be referred to as an “Entrant.”
To enter and Entry complete all the required information on the form at the website: www.redclaystrays.com. You may select to opt out of being included on an email list for promotional information. Limit of up to one (1) Entry per person throughout the Promotion. Entries in excess of one (1) Entry per person will be considered void. .
The Promotion starts at 10:00am CST on 06/09/2026 and ends at 5:00 pm CST on 06/09/2026 (“Promotion Period”). At the end of the Promotion Period, prizes will be awarded to eligible Entrants selected at random by Sponsor from all qualified Entrants (“Winners”).
There will be forty (40) prizes consisting of an Exclusive Grateful XL Test Edition Print (“Prize”), valued at a maximum of fifty dollars ($50 USD) each. Sponsor has the right in its sole discretion to substitute a prize (or a portion thereof) with a prize of equal or greater or equal value if the stated Prize (or any portion thereof) is not available. Prizes are not transferable or assignable. The Winners will be selected in a random drawing to take place within forty-eight (48) hours following the close of the Promotion Period. Odds of winning depend on the total number of eligible Entries received.
The Winner will be solely responsible for all federal, state, and/or local taxes, or for other fees or costs associated with the Entry, Prize, or the Entrant’s receipt or enjoyment of the Prize. The Winner may be required to provide Sponsor with information for tax reporting purposes. Once submitted, no Entry can be returned or confirmed. All entries once submitted become the property of Sponsor.
The Sponsor will notify the Winners via the email provided in the Entry form within forty-eight (48) hours of the Drawing or as soon as reasonably practicable. Within approximately ten (10) days after the Sponsor notifies the Winners, Sponsor will ship the Prizes to the Winners using the address provided by the Winners in their Entry, using such delivery method and carrier as selected by the Sponsors. Sponsor does not guarantee delivery of the Prizes by such carrier. To obtain the a list of Winners’ names, if access required by law, please email redclaystrays@soundwavescreative.com.
By participating in the Promotion, you represent and warrant as follows: all information provided by you in connection with this Promotion is truthful, current and accurate; you meet the eligibility requirements set forth in these Official Rules; and all materials submitted by you as part of your submission are compliant with the content guidelines set forth these Official Rules;
By entering this Promotion, you acknowledge and agree that your participation in this Promotion is expressly subject to the following additional terms and conditions. Entrant grants Sponsor the right to contact the Entrant by email or otherwise about this Promotion. Your Entry will be at the sole and absolute discretion of the Sponsor and that the Sponsor will have no obligation to use your Entry, in whole or in part, in any manner or for any purpose. You shall have no right of approval of any use of the materials in your Entry, no claim or right to any payment, royalty or other monetary compensation for use of any materials in your submission, and no claim (including, without limitation, claims based upon copyright infringement, invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, distortion, illusionary effect, faulty reproduction, fictionalization, or use in any composite form of the materials in your submission. You agree to indemnify and hold the Sponsor harmless from and against any and all third-party claims arising out of: (1) your breach or violation of any of the provisions of these Official Rules or any applicable law; and/or (2) your breach of any of the representations and warranties set forth in these Official Rules. If the Sponsor, at its sole discretion, determines that an Entrant has or intends to take any action or inaction that is designed to or has the effect of allowing the entrant to cheat, obtain an unfair advantage, to circumvent the Rules, or otherwise interfere in the administration, security, fairness, integrity, or proper conduct of the Promotion, the Sponsor may disqualify the Entrant from the Promotion as well as other existing or future Promotion that may be offered by Sponsor in the future. Any Winners determined by Sponsor, at its sole discretion, to have been engaged in or attempted cheating will be immediately disqualified and will forfeit any right to a prize or be obligated to refund the prize to Sponsor if already awarded.
Entrants understand and agree that Sponsor will obtain and store certain personal information, including but not limited to their full legal name, address, email address, phone number and if required to be provided to Sponsor by a potential prize Winners, a social security number, along with general information about any prize Winners for the purpose of administering and/or managing this Promotion as well as complying with applicable laws, regulations, and rules. Entrants understand that such personal information may be transferred for processing or storage to a jurisdiction outside of the state in which it was collected. Entrants have the right to request their personal information not be used for the purpose of administering and/or managing the Promotion and understand that such a request will cause them to be automatically disqualified from this Promotion, as well as potentially other existing or future promotions offered by Sponsor. To engage in this privacy request, or any other similar request, entrants should contact the Sponsor in writing at the address described at the end of these Rules or as otherwise specified by Sponsor’s Privacy Policy.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants or Sponsor in connection with this Promotion are governed by and construed in accordance with the laws of the State of Tennessee without giving effect to any choice of law or conflict of law rules (whether of the State of Tennessee or any other jurisdiction) that would cause the application of any other state’s laws.
ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: 1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION OR AWARD; 2) ANY AND ALL CLAIMS, JUDGMENTS, SETTLEMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED THE APPROXIMATE RETAIL VALUE OF THE PRIZE, BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; 3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHT TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGE, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES, IF ANY, OR ANY RIGHT TO HAVE ANY DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND 4) ENTRANT’S REMEDIES WILL BE LIMITED SOLELY TO A CLAIM FOR MONEY DAMAGES, IF ANY, AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. WHERE SUCH EXCLUSIONS ARE NOT PERMITTED BY LAW, THEY DO NOT APPLY.
